Wrongful
Death
An
Outline of Required Information
Experience
- Raffa
Consulting Economists has been evaluating wrongful
death claims since 1971. This analysis includes
a present value assessment, where appropriate, of
the loss of earnings (from date of injury to date
of death); the loss of monetary or financial support
to the survivors; the loss of the decedent's services
to survivors; and if identified statutorily, the loss
of inheritance or the loss of net accumulations to
the estate of the decedent.
Methodology
- Raffa
Consulting Economists historical earnings data bases
are used to establish earnings growth rates with which
to project the future earnings of the decedent and
to estimate replacement wage rates for the loss of
services evaluation. Data compiled from the
U.S. Department of Labor's Consumer Expenditures
Survey are utilized to allocate the projected
earnings of the decedent between the claims of the
survivors and the personal consumption expenditures
of the decedent. Present values calculations
are made using interest rates reflecting a twelve-month
moving average yield on long-term U.S. Treasury Bonds.
